RULES: EVEREADY "CHOOSE YOUR POWER” COMPETITION ("Competition”)

By entering this Competition and/or accepting any prize, all participants, entrants and winners agree to be bound by the terms and conditions below applicable to this Competition ("Rules”) run by Eveready Proprietary Limited and/or its agencies (collectively, the "Organisers”) from time to time.

Copies of these Rules are available at the Eveready website accessible at www.eveready.co.za ("Website”).

You may not participate in this Competition if you do not agree to be bound by these Rules and if you enter this Competition or participate further in this Competition, doing so will be confirmation that you agree to these Rules.

The Organisers may in their sole discretion amend these Rules at any time, without notice, and such amendment(s) shall be deemed to have taken effect from the date the revised Rules are available on the Website.

Competition Period

The Competition will begin on 1 May 2017 and will end on 31 July 2017 ("Competition Period”). No entries will be accepted after 23:59 on 31 July 2017.

Eligible entrants

In order to be eligible for participation in this Competition, an entrant must be:

• 18 (eighteen) years of age or older or, if younger than 18 (eighteen) years, be assisted to the extent necessary by a parent/legal guardian;
• in possession of a valid South African identity document, South African passport or be a permanent resident of South Africa;
• willing to divulge their full name/s, identity number (or passport number/permanent residency number) and mobile telephone number to the Organisers, which information shall be kept strictly confidential at all times,

and each entrant represents and warrants that by entering in or participating in this Competition, he/she has full eligibility to do so. The Organisers reserve the right to request proof that entrants have met these eligibility requirements.

How to Participate

1. Entry into the Competition

1.1. To enter the Competition and stand a chance of winning your share of R100 000, as set out in paragraph 2 below, eligible entrants will be required to purchase a promotional pack of Eveready Platinum batteries ("Product”) from any SPAR store.

1.2. Entrants will then need to enter their unique code contained in the promotional sticker on the Product packaging and Whatsapp this code along with a clear photo of their SPAR till slip to 060 557 4210. Partial or unclear photos will automatically be rejected.

1.3. Entrants may enter the Competition each time they make a purchase of a Product during the Competition Period by following the steps set out in paragraphs 1.1 to 1.3 above. One (1) purchase of a Product at any SPAR store entitles entrants to one (1) Competition entry.

1.4. The cost for entering the Competition is part of the participant’s cellular data bundle, at the rate at which the participant’s service provider will charge for sending a WhatsApp message with a photo. No other network fees (e.g. SMS, MMS) apply.

2. Nature of Prize and Prize allocation

2.1. Entrants stand a chance of winning a choice of 1 (one) of the R1000 (one thousand rand) prizes available ("Prizes”). A total of 100 prizes (each to the value of R1000) will be awarded during the Competition period.

2.1.1. Winners may select 1 (one) of the following options as their Prize:

2.1.1.1. R1000 Airtime OR R1000 Spar voucher OR R1000 Electricity voucher.

2.2. The winners will be randomly selected by means of a random number generator conducted during the competition period.

2.3. A total of 100 (one hundred) winners (as set out in paragraph 2.1) will be randomly selected from all the valid entries received by the Organisers during the Competition Period.

2.4. The Prizes are not transferable and the Organisers reserve the right to substitute any Prize with another prize of similar value.

3. Winners

3.1. The Winners will be notified via a WhatsApp message in reply to the number used when submitting their entry, within 72 hours of being chosen as a winner. Depending on their prize selection, winners will be awarded as follows:

3.1.1. Airtime will be topped up on the cell number used to enter the competition.

3.1.2. SPAR voucher winners must supply their best daytime physical address for delivery of the voucher. No postal addresses will be accepted.

3.1.3. Electricity winners must supply their prepaid electricity meter number and municipality/private meter company details and a digital electricity voucher will be sent to the cell phone number used to enter the competition.

3.2. Should a winner not respond to the Organiser’s attempts to contact him/her within 5 (five) days of the Organiser’s first attempt, the prize will be forfeited and another winner will be selected.

3.3. A Winner is only eligible to win one Prize per unique entry during the Competition period.

General terms

The promoter/s of this Competition are the Organisers. The Organisers will interpret the Rules in their sole discretion and reserve the right to amend the Rules at any time in accordance with the provisions contained in these Rules.

The Organisers, their directors, members, partners, employees, agents, consultants, any other person who directly or indirectly controls or is controlled by them or any supplier of goods and services in connection with this Competition and their spouses, life partners, parents, children, siblings, business partners or associates are not eligible to participate in or enter this Competition.

By entering and participating in the Competition, you agree that we may collect and process your personal information for purposes of this Competition.

Entrants who, in the Organisers’ sole determination, act unlawfully, fraudulently, in breach of these Rules or otherwise dishonestly may be disqualified from participating in the Competition and shall not be eligible to win any prize.

IN THE EVENT OF A DISPUTE, THE DECISION OF THE ORGANISERS WILL BE FINAL AND BINDING AND NO CORRESPONDENCE WILL BE ENTERED INTO. IN THIS REGARD AND FOR FURTHER CLARITY, THE ORGANISERS SHALL BE ENTITLED TO DEAL WITH SUCH DISPUTES (OR ANY FAILURE BY PARTICIPANTS TO FOLLOW THE RULES) IN THEIR SOLE DISCRETION, INCLUDING THAT THE ORGANISERS SHALL BE ENTITLED, IN ADDITION TO ANY OTHER RIGHTS WHICH THE ORGANISERS MAY HAVE IN TERMS OF THESE RULES, TO IMMEDIATELY DISQUALIFY PARTICIPANTS FROM THIS COMPETITION. BY ENTERING THE COMPETITION AND/OR ACCEPTING ANY PRIZE, THE ENTRANTS, USERS AND/OR WINNERS HEREBY INDEMNIFY, RELEASE AND HOLD HARMLESS THE ORGANISERS (INCLUDING THEIR SUBSIDIARIES, HOLDING COMPANIES AND AFFILIATES), THEIR DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS AND CONTRACTORS (THE "ORGANISER PARTIES”) FROM AND AGAINST ANY ACTIONS, CLAIMS AND/OR LIABILITY FOR INJURY, LOSS, DAMAGE, EXPENSE, CLAIM OR DAMAGES OF ANY KIND RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM PARTICIPATION IN THE COMPETITION, AND/OR THE USE, ACCEPTANCE OR POSSESSION OF A PRIZE, AND/OR PARTICIPATION (OR NON-PARTICIPATION) IN A PRIZE-RELATED ACTIVITY.

The Organisers may require the winner (at no fee) to be identified, photographed, filmed and the aforegoing to be published in any media, subject to the winner's right to decline participating in any such marketing activities. If a winner so declines, notice thereof must be submitted to the Organisers in writing.

ADDITIONAL TO ANY OTHER RIGHTS CONTAINED IN THESE RULES, THE ORGANISERS RESERVE THE RIGHT TO TERMINATE THE COMPETITION AT ANY TIME WITH IMMEDIATE EFFECT. IF THIS IS THE CASE, THE ORGANISERS WILL PROVIDE A NOTICE ON THE WEBSITE AND IT SHALL BE THE RESPONSIBILITY OF ENTRANTS TO VISIT SUCH WEBSITE IN THIS RESPECT. IN SUCH EVENT, ALL ENTRANTS HEREBY WAIVE ANY RIGHTS WHICH THEY MAY HAVE AGAINST ANY OF THE ORGANISER PARTIES AND ACKNOWLEDGE THAT THEY WILL HAVE NO RECOURSE OR CLAIM OF ANY NATURE AGAINST THE ORGANISER PARTIES.

ANY PRIZE IS ACCEPTED BY A WINNER AT HIS/HER OWN RISK AND THE ORGANISERS ARE NOT LIABLE, AT ANY TIME, FOR ANY DEFECT IN THE PRIZE.

The duration of this Competition may also be extended or curtailed at the sole discretion of the Organisers. If this is the case, the Organisers will provide notice of this on the Website.
